These terms and conditions (“Rental Contract”) apply to all trailer hire services provided by Hutchbrook Group, and consist of:
- The Rental Agreement signed by the customer;
- Our Privacy Policy;
- These Terms and Conditions.
By entering into the Rental Contract, you agree to be bound by the following terms.

1. Introduction
1.1 This Rental Contract governs the hire of trailers from Hutchbrook Group.
1.2 It is governed by the laws of the state or territory where the trailer is rented.
1.3 Your rights under Australian Consumer Law are preserved.
1.4 Trailer sizes are approximate only. If unsure, choose a larger size.
1.5 We may exchange the trailer for an equivalent one.
1.6 Enclosed trailers are not guaranteed to be waterproof or dust-proof.
1.7 Digital signatures are legally binding.

2. Who May Tow the Trailer
- Only you or an Authorised Driver (approved by us) may tow the trailer.
- Drivers must be aged 18–75, with at least 12 months’ driving experience.
- Valid, unrestricted licences are required (no learners).
- No false or misleading details allowed.
- Trailers may not be towed if your licence is cancelled or suspended.

3. Prohibited Use You must not:
- Tow the trailer while intoxicated or dangerously.
- Use it for illegal activities or with illegal/dangerous goods.
- Modify, damage, resell, or register ownership of the trailer.
- Overload the trailer or exceed its design/load capacity.

4. Prohibited Areas of Use The trailer must not be towed:
- Off-road or on unsealed roads.
- In snow-prone or flooded areas.
- On closed or unsafe roads.

5. Your Obligations
- Present valid ID and inspect the trailer before hire.
- Use a 50mm tow ball.
- Ensure proper load placement (70% of weight at front), coupling, safety chains, tyre inflation, and lighting.
- Return the trailer clean, on time, and in good condition.
- Notify us immediately if faults occur.

6. Damage Cover
- You are liable for all damage
- You must arrange your own insurance.

7. Rental Period, Fees, and Charges
- Minimum rental is 24 hours.
- Extensions must be requested before expiry.
- Late returns incur 150% surcharge.
- Trailers not returned to the correct address incur a $1,000.00 recovery fee (plus $2.00/km beyond 100km).
- Cleaning or damage may incur extra charges.
- All fines, tolls, and penalties are your responsibility.

8. Safety
- You are responsible for safe towing.
- Agents are not accredited trainers.
- Don’t use the trailer if it appears unsafe—report issues immediately.

9. Accidents and Breakdowns
- Contact us immediately if the trailer breaks down.
- You are liable for damage if caused by your misuse.
- We are not responsible for tyre changes, loss of enjoyment, or consequential damages.

10. Reporting Accidents
- All accidents/thefts must be reported to us within 24 hours.
- Serious incidents must be reported to police.
- Exchange details with other drivers and take photos.
- Do not admit fault or make promises.

11. Major Breach Consequences If you commit a Major Breach, you:
- Must pay for all damage and losses.
- Risk immediate termination of the contract and trailer recovery.

12. Privacy
- We collect only necessary personal information and protect it in accordance with law.
- GPS tracking may be used for safety and recovery
- Tampering with tracking devices is prohibited.

13. Definitions and interpretation
13.1 Definitions
In these Terms and Conditions:
- Accident means an unintended and unforeseen incident, including: (a) a collision between the Trailer and another vehicle or object, including animals and roadside infrastructure; (b) rollovers; or (c) a weather event, including hail Damage, that results in Damage or Third Party Loss.
- Authorised Driver means any driver of the Towing Vehicle who is approved by Us to tow the Trailer and who is recorded on the Rental Agreement prior to the Start of the Rental.
- Damage means: (a) any loss or damage to the Trailer including its parts, components and accessories, including the GPS unit, that is not fair wear and tear; (b) towing and salvage costs; (c) assessing fees; (d) claims administration fee; and (e) Loss of Use, and for the removal of doubt, any Damage to the windscreen, headlights, lights or tyres that makes the Trailer unroadworthy is not fair wear and tear.
- Damage Excess means the amount, including GST, up to which You must pay Us in the event of an Accident that causes Damage or Third Party Loss or the Trailer has been stolen.
- End of the Rental means the date and time shown in the Rental Agreement or the date and time the Trailer is returned to Us, whichever is the later.
- Loss of Use means Our loss calculated on a daily basis at the daily rate shown in the Rental Agreement because the Trailer is being repaired or replaced if it is written off as a result of an Accident or it has been stolen.
- Major Breach means a breach of any of the following: (a) clauses, 2 (all parts), 3 (all parts), 4 (all parts), that causes Damage, theft of the Trailer or Third Party Loss; or (b) clause that prevents Us from properly investigating a claim arising from an Accident or theft or from prosecuting or defending any Accident or theft claim.
- Off Road means any area that is neither a sealed or unsealed road and includes but is not limited to unformed roads, fire trails, tracks, river and tidal crossings, creek beds, beaches, streams, dams, rivers, flood waters, sand, deserts, rocks, fields and paddocks.
- Rental Charges means the charges payable for renting the Trailer from Us together with GST and any other taxes or levies which are all fully set out in the Rental Agreement.
- Rental Location means the location from which the Trailer is rented, as shown on the Rental Agreement.
- Rental Period means the period commencing at the time shown in the Rental Agreement and concluding at the End of the Rental.
- Start of the Rental means the date and time that the rental commences as shown in the Rental Agreement.
- Third Party Loss means loss or damage to third party property, including other motor vehicles and any claim for third party loss of income.
- Towing Vehicle means the Vehicle described on the Rental Agreement as the vehicle that will tow the Trailer.
- Trailer means the Trailer described in the Rental Agreement and includes its parts, components and accessories.
- Unsealed Road means a road that has been formed and constructed but is not sealed with a hard material such as tar, bitumen or concrete.

- You, Your means the person, whether it is an individual, a firm or company or government agency that rents the Trailer from Us and whose name is shown in the Rental Agreement.

Accident: An unintended incident causing damage.
Authorised Driver: Any approved driver listed in the agreement.
Damage: Any loss or harm to the trailer excluding fair wear and tear.
Damage Excess: The amount you pay in case of an accident.
End of the Rental: The actual return date/time or as agreed.
Loss of Use: Our daily loss if the trailer is unavailable.
Major Breach: Violations causing damage or blocking investigations.
Off Road: Any unformed or unsafe road or area.
Rental Charges: Fees stated in your Rental Agreement.
Rental Location: Where the trailer is picked up.
Rental Period: Start to end time of trailer hire.
Start of the Rental: Commencement time as agreed.
Third Party Loss: Damage to others' property or income.
Towing Vehicle: Your towing vehicle registered with us.
Trailer: The hired equipment.
Unsealed Road: Formed road not sealed with tar or concrete.
We/Us/Our: Hutchbrook Group.
You/Your: The renting customer.
